1. Introduction
These General Terms and Conditions ("General Terms") govern your overall relationship with Everlasting Private Tours ("Everlasting", "we", "us") whenever you use our website, contact us, request a quotation, make a booking or travel with us. They are written in plain and understandable language, as required by section 22 of the Consumer Protection Act 68 of 2008 ("CPA").
2. Our documents and how they fit together
- These General Terms set the overall framework for our relationship.
- The Booking Terms and Conditions govern bookings, payments, changes, cancellations and refunds.
- The Website Terms and Conditions govern the use of our website.
- The Privacy Policy explains how we handle personal information under POPIA.
- The Indemnity Form records the risk acknowledgement we request from guests before a tour.
If there is a conflict between documents, the more specific document applies to its own subject matter, and any specific written terms in a quotation, invoice or confirmation apply to that booking.
3. Who we are
Everlasting Private Tours is a South African private tour operator and guiding business based in Cape Town, Western Cape. Our tourist guides are registered as required by the Tourism Act 3 of 2014, and passenger transport used on our tours is operated under the licences required by South African road transportation law, whether by us or by licensed transport partners.
4. Our services
We provide private tours, custom itineraries, professional guiding, transfers arranged with licensed operators, and related travel planning support. Service descriptions, routes, durations and inclusions are set out on our website and in written quotations, and may be adjusted in the circumstances described in the Booking Terms.
5. Quotations and electronic dealings
Quotations are open for acceptance for the period stated on them and lapse automatically afterwards. In terms of the Electronic Communications and Transactions Act 25 of 2002, agreements, notices and records exchanged by email or through our website are legally valid, and a clear electronic acceptance — such as ticking a checkbox, replying by email or paying an invoice — has binding legal effect.
6. Your consumer rights
Nothing in our documents removes or limits rights you have under the CPA or any other South African consumer protection law. Where the CPA applies to your booking, you are entitled to services of the quality that persons are generally entitled to expect, to fair, just and reasonable terms, and to fair handling of cancellations and refunds as set out in the Booking Terms.
7. Privacy
We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA") and our Privacy Policy. This includes guest details, special requirements, emergency contacts and payment-related information reasonably needed to deliver our services safely and lawfully.
8. Intellectual property
The content of our website and materials — including text, branding, tour descriptions, itineraries, photographs and design — belongs to Everlasting Private Tours or is used under licence. You may not copy, reproduce, adapt or use it for commercial purposes without our prior written permission.
9. Transfers and subcontracting
You may not transfer a booking or your rights under our terms to another person without our written consent, which we will not unreasonably withhold. We may use carefully selected suppliers and subcontractors to deliver parts of a service; we remain your point of contact for the booking.
10. Severability, waiver and updates
If any provision of our documents is found to be unenforceable, the remaining provisions stay in force. Our failure to enforce a provision at any time is not a waiver of that provision. We may update our published terms from time to time; the version published on our website at the time you make a booking applies to that booking.
11. Governing law and disputes
Our relationship is governed by the laws of the Republic of South Africa. If a problem arises, please contact us first — most issues can be resolved quickly and directly. You may also refer a consumer complaint to the Western Cape Office of the Consumer Protector or the National Consumer Commission, or approach the courts.
